Many times I will be asked as a Real Estate Attorney, when exactly should we have an inspection performed on the property. Ideally, that inspection should be performed before the contract is signed. This way if anything comes up, if there are any issues, whether it's leaks in the roof or foundational issues or environmental violations, whatever it may be, there will be ample time to negotiate it in terms of the contract. I advise clients as a Real Estate Attorney that we can also provide in the contract for certain contingencies and then have the inspection performed after. We can set up a number of provisions, but ideally the inspection should be performed before the contracts are signed.
